1. AGREEMENT TO TERMS
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and the operators of My Tally ("we", "us", or "our"). By accessing or using the My Tally application (the "App") or this website, you agree to be bound by these Terms. If you do not agree, you must immediately cease all use of the App and the website.
2. ELIGIBILITY AND ACCOUNT SECURITY
- 2.1 Capacity: You must be at least 18 years of age to use this App.
- 2.2 Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use.
- 2.3 Biometrics: The App may utilise your device’s native biometric authentication (e.g., fingerprint or facial recognition). These templates are stored solely on your device and are never transmitted to our servers or stored within our cloud infrastructure.
3. NATURE OF SERVICE AND NO FINANCIAL ADVICE
- 3.1 Information Only: My Tally is a record-keeping and data visualisation tool. All content, including automated insights, trend analysis, budget planner forecasts, and tax estimates, is provided for informational purposes only.
- 3.2 No Advice: We do not provide financial, investment, tax, or legal advice. My Tally is not a substitute for professional consultation with a registered tax agent, financial advisor, or legal professional.
- 3.3 Australian Context: While the App uses Australian financial terminology (e.g., GST, Superannuation, Logbook Tracking), you are responsible for ensuring your use of the App complies with your specific tax and reporting obligations under Australian law.
- 3.4 Shared Information: The App allows you to share expenses and contacts. You are solely responsible for ensuring you have the right to share such information and for settling any shared debts. We do not act as an intermediary for payments.
4. AUTOMATED DATA PROCESSING AND ACCURACY
- 4.1 System Processing: The App uses advanced automated systems to extract data from receipts and provide forecasting. You acknowledge that these systems are probabilistic and may produce errors, omissions, or inaccuracies.
- 4.2 User Verification: You are strictly responsible for verifying the accuracy of all data analysed by the system (including merchant names, dates, amounts, and GST) before confirming and saving any record.
- 4.3 Liability: We are not liable for any financial decisions, tax filing errors, or losses resulting from inaccurate automated data extraction or trend modelling.
5. LIMITATION OF LIABILITY
To the maximum extent permitted by the Australian Consumer Law, My Tally is provided "as is" and "as available". We exclude all warranties, express or implied. We are not liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising from your use of the App.
6. GOVERNING LAW
These Terms are governed by the laws of Australia and the specific State or Territory of your residence.
